TERMS AND CONDITIONS OF SALE (CGV)
PREAMBLE
This site is published by ATELIER DUNE.
These general terms and conditions of sale (hereinafter referred to as "GTCS") define the contractual rights and obligations of ATELIER DUNE and its customer in the context of a distance and electronic sale of goods and products.
The T&Cs govern exclusively the relationship between ATELIER DUNE and the customer.
The GCS express the entirety of the obligations of the parties. The customer is deemed to accept them without reservation, failing which the order will not be validated.
In the event of doubt concerning any of the terms and conditions of sale, the practices in force in the distance selling sector by companies whose registered office is in France and the French Consumer Code shall apply.
ARTICLE 1. ONLINE SHOP
Through the site ATELIER DUNE , the customer is provided with an online store that accurately presents the products sold, without the photographs having any contractual value.
The products are described and presented as accurately as possible. However, in the event of errors or omissions in the presentation, the seller cannot be held responsible.
The colors and images of the products that appear on the site are displayed as clearly as possible, but ATELIER DUNE cannot guarantee that the display of colors will reflect the exact reality of the colors, which may vary depending, for example, on the computer or telephone screen, or the settings set.
Products are offered while stocks last.
Typographical errors, inaccuracies or omissions in product descriptions, prices, promotions, offers, product shipping costs, delivery times and availability are possible. ATELIER DUNE reserves the right to correct any errors, inaccuracies, omissions, and to change or update information or cancel orders, if any information is inaccurate, at any time and without notice (including after orders are placed).
ARTICLE 2. PRICES
ATELIER DUNE reserves the right to modify its prices at any time by publishing them online.
Only the prices in force at the time of the order will apply, subject to product availability at that date.
Prices are given in euros (all taxes included) and do not include delivery charges, which are invoiced in addition. Delivery costs are indicated before the customer confirms the order. Customs clearance fees may apply in the countries concerned.
Prices take account of taxes applicable on the day of the order, and any change in the rate of these taxes will automatically be reflected in the price of products in the online store. If one or more taxes or contributions, in particular environmental taxes, were to be created or modified, either upwards or downwards, this change could be passed on to the sale price of the products.
The total amount of the order (all taxes included), including delivery costs, is indicated before final validation of the order form.
Full payment must be made at the time of ordering.
In the event of an erroneous or obviously derisory price (low price) being displayed, for whatever reason (computer bug, manual error, technical error), the order, even if validated, will be cancelled. The customer will be informed as soon as possible. He will be able, if he wishes, to place his order again at the corrected and exact price.
ARTICLE 3. ONLINE ORDERING
The customer can fill in an order form online, using an electronic form. By completing the electronic form, the customer accepts the price and description of the products.
The customer will have to accept by clicking in the indicated place, the present GCS, for his order to be validated.
The customer must provide a valid e-mail address and delivery address, and hereby acknowledges that any exchange with ATELIER DUNE may take place via this address.
The customer must also choose the delivery method and validate the payment method.
ATELIER DUNE reserves the right to block the customer's order in the event of non-payment, incorrect address or any other problem with the customer's account, until the problem is resolved.
ARTICLE 4. ORDER CONFIRMATION AND PAYMENT
This is an order with a payment obligation, which means that placing the order implies payment by the customer.
4.1. PAYMENT
The customer makes the payment at the time of the final validation of the order.
The price of products purchased is payable in full on the day the order is placed by the customer. Payment is made online using the following payment methods the following methods of payment (Carte Bleue, Visa, Eurocard/Mastercard) when the order is validated by the customer. The customer guarantees the seller that he/she has the necessary authorizations to use this method of payment, and acknowledges that the information given for this purpose is proof of his/her consent to the sale and to the payment of the sums due for the order.
Authorization to debit the card is requested when the order is validated on the site, except in the event of server unavailability.
In the event of refusal to authorize payment by credit card by the accredited organizations, or in the event of non-payment, ATELIER DUNE reserves the right to suspend or cancel the order and its delivery.
ATELIER DUNE also reserves the right to refuse an order from a buyer who has not paid in full or in part for a previous order, or with whom a payment dispute is in progress.
In the event of fraudulent use of a bank card on the site, the customer is invited to contact ATELIER DUNE by e-mail at the contact e-mail address.
Payment information is transmitted according to the highest security standards.
Payment is entirely secure on the site, thanks to the online payment system of our partner STRIPE, a PCI/DSS level 1-certified payment solution (the highest level of security for online payments). Card/bank details entered on the site are encrypted and never circulate unencrypted on the Internet. What's more, they are processed only by STRIPE, and never come into the possession of ATELIER DUNE. When customers enter their card number to make purchases on the site, the information is actually transmitted to STRIPE.
4.2. CONFIRMATION
On receipt of the customer's validation of the purchase and payment, ATELIER DUNE sends the customer confirmation of receipt of the order to the e-mail address specified by the customer.
At the customer's request, ATELIER DUNE will send the customer an invoice upon delivery.
In the event of debit or collection of an order for an unavailable item, ATELIER DUNE undertakes to offer a credit note or refund the customer within 14 days. ATELIER DUNE undertakes to notify by e-mail any customer who has placed an order for an unavailable item.
For any question relating to the follow-up of an order, the customer can contact customer service at the contact e-mail address.
ARTICLE 5. ELECTRONIC SIGNATURE
In accordance with the provisions of Law no. 2000-230 of March 13, 2000, the online provision of the buyer's credit card number and the final validation of the order constitute proof of the customer's agreement, of the payability of the sums due under the purchase order, and of the signature and express acceptance of all operations carried out.
ARTICLE 6. PROOF OF TRANSACTION
Communications, orders and payments between the customer and ATELIER DUNE may be proven by means of computerized registers stored in ATELIER DUNE 's computer systems under reasonable conditions of security. Purchase orders are archived on a reliable and durable medium considered, in particular, as a means of proof.
ARTICLE 7. METHOD OF PAYMENT
All payment methods available to the customer are listed on the seller's website. The customer guarantees the seller that he/she has the necessary authorizations to use the method of payment chosen by him/her when placing the order.
ARTICLE 8. DELIVERY
Delivery is only made after confirmation of payment by the seller's bank.
Products are delivered to the address indicated by the customer on the online form The customer is responsible for the accuracy of this information.
Any parcel returned to the seller because of an incorrect or incomplete delivery address will be reshipped at the customer's expense.
Except in the case of force majeure, delivery takes place within 3 to 7 working days from the order date throughout metropolitan France, depending on the method chosen by the customer. This period is given as an indication and may vary according to the availability of items.
Any delivery to another country of the European Union or to any other country can be made after agreement of the parties on the conditions and costs of delivery.
8.1. DELAY IN DELIVERY AND NOTICE OF DEFAULT
Exceeding the delivery date cannot be held against ATELIER DUNE, nor can it give rise to termination of the contract or any compensation for damages. After a period of one month from the date of order, and at the customer's request (via the contact e-mail address), ATELIER DUNE will refund the undelivered goods and delivery charges by cheque or bank transfer.
Packages are delivered by La Poste or an express carrier to the address indicated on the order. As such, ATELIER DUNE cannot guarantee a precise delivery time. The transfer of risk occurs at the time of delivery.
Any denunciation not made according to the rules defined above and within the allotted time cannot be taken into account and will release ATELIER DUNE from any responsibility towards the customer.
8.2. ORDER VERIFICATION
Products must be checked by the customer on delivery. Any reservations must be noted on the delivery slip presented by the carrier.
8.3. DEFECTIVE, DAMAGED OR INCORRECT PRODUCTS
In the event of apparent defects (damaged parcel, missing product, open parcel, etc.), non-conformity or error of the products in relation to the information given on the order form, the customer must submit a claim, enclosing all irrefutable proof of good faith (testimonials, photos, etc.), to ATELIER DUNE at the contact e-mail address within three (3) days of delivery.
ATELIER DUNE reserves the right to refuse a request depending on the quality of the elements received. If it is proven that the error originates exclusively fromAtelier DUNE, the brand undertakes to exchange the products within the limits of available stocks, and will bear the cost of return delivery.
If the product is no longer available, the customer will receive an equivalent product or a refund.
8.4. RIGHT OF WITHDRAWAL
For products purchased online, the customer has a period of 14 working days from the date of receipt of the goods to request a refund for one or more items in the order and to return the goods. This period begins with the postmark or the date of the delivery receipt. The customer must make this request in writing to the contact e-mail address.
Once the customer has informed ATELIER DUNE of his/her decision to withdraw from the contract, he/she must send the product(s) within 14 days, together with the return form to the following address

Shipping costs for returns are at the customer's expense and are non-refundable, unless ATELIER DUNE has made an error in shipping the original order. ATELIER DUNE cannot be held responsible for any loss or damage in transit, and the customer is therefore advised to use a tracked shipping service. In the event of loss or damage in transit, the customer should contact the carrier directly. If items are not received at the address below, ATELIER DUNE will not be able to process the return.
Refunds, whether total or partial, will be made as soon as possible and within 30 working days of receipt of the returned goods by ATELIER DUNE . Refunds will be made by bank transfer to the order of the customer, in accordance with the information provided at the time of ordering. Products returned damaged, incomplete, soiled or without the original packaging will not be accepted for return, exchange or refund.
After a period of 14 working days from delivery, goods will not be taken back or reimbursed.
ARTICLE 9. PRODUCT WARRANTIES
ATELIER DUNE is the guarantor of product conformity with the contract.
The customer may make a claim under the warranty for defects provided for in articles 1641 et seq. of the French Civil Code. If the customer invokes the warranty for defects provided for in articles 1641 et seq. of the French Civil Code, he may choose between rescission of the sale or a reduction in the price, in accordance with article 1644 of the French Civil Code.
ARTICLE 10. UNAVAILABILITY OF PRODUCTS AND REIMBURSEMENT
In the event of unavailability of an ordered product, the customer will be informed by e-mail.
The customer will have the option of cancelling his order and will thus have the choice between reimbursing the sums paid by him within 30 days at the latest of their payment, or exchanging the product for an equivalent one.
